Gusto Casa terms and conditions

Gusto Casa is a website for homeowners (sellers) and house hunters (buyers). Gusto Casa puts these parties in touch with each other, and with third parties, via the website operated by Gusto Casa (hereafter: the ‘Gusto Casa Website’).

General

Use of the Gusto Casa Website is subject to the Terms of Use as described here and to the Privacy statement. If you cannot agree to our terms, you should not take out any subscriptions or otherwise make use of Gusto Casa.

Applicability

These Terms of Use apply to all agreements, all offers and all services of Gusto Casa unless stated otherwise. Deviations from these Terms of Use are valid only if they have been expressly agreed with you in writing.

Your rights and obligations

As a user of the Gusto Casa Website you must conduct yourself in every respect as may be expected of a responsible and careful internet user. Among other things, you may not use the Website (or its content) for acts and/or conduct contrary to the law, public order or public decency.

More specifically, the following acts and/or conduct are not permitted:

• posting any content or material that contains incorrect or misleading information;
• posting any content or other material that is not based on a concrete housing need that is personally relevant to you;
• infringing, or otherwise acting in breach of, the intellectual property rights of Gusto Casa and/or third parties;
• making infringing, unlawful or misleading statements;
• distributing material prohibited by law;
• circumventing or removing the security of (parts of) the Website.

You may place a hyperlink (a technical command that refers to a Gusto Casa website, with the website appearing within Gusto Casa's frame) only if Gusto Casa has given you prior written permission to do so. Requests to place a hyperlink can be sent to info@gustocasa.nl.

If you do not keep to the permitted use described above, Gusto Casa reserves the right to block your access to your account, to remove the material you have posted and to recover from you any damage resulting from this unpermitted use, all without Gusto Casa being obliged to make any refund to you.

An account can be created only after successful payment for the package of your choice. If successful payment is not received, or the payment subsequently ceases to count as successful, Gusto Casa is not obliged to post the material you have offered on the Gusto Casa Website.

Material

By posting material (such as photos and texts) on Gusto Casa, you give Gusto Casa permission to use it for Gusto Casa's publicity purposes. Some posted material may be shown through other distribution channels, such as newspapers or websites not affiliated with Gusto Casa. By using Gusto Casa's services you agree that your material may be shown through these other distribution channels. Material used online will be removed at the request of the person who originally posted it.

Gusto Casa has the right to remove your material if Gusto Casa receives a report that it is unlawful, causes problems or otherwise conflicts with any law and/or its policies.

Costs and use

Gusto Casa supports private individuals in buying or selling their home. For this you owe the cost of the package you have chosen, paid in advance.

Liability and indemnity

Gusto Casa has no obligation other than to display the material you have offered on the Gusto Casa Website. Gusto Casa is in no way a party to contacts between you and parties responding to your advertisement, nor to any agreements arising from them. If a dispute arises between you and a party you came into contact with via the Gusto Casa Website, Gusto Casa is not a party to it. If you are in doubt about the accuracy of information shown on the Gusto Casa Website, or find inaccuracies, we advise you to contact whoever is offering the information concerned (usually the selling party). Gusto Casa is not liable for damage arising directly or indirectly from the use of information you obtain from Gusto Casa.

Gusto Casa cannot guarantee that your use of the Gusto Casa Website will lead to one or more homes being offered to you, or that an offer will lead to a successful purchase for you.

The Gusto Casa Website may refer to the services of third parties. Gusto Casa is in no way a party to contacts between you and these third parties, nor to any agreements arising from them. If a dispute arises between you and a third party you came into contact with via the Gusto Casa Website, Gusto Casa is not a party to it.

Gusto Casa is not liable for damage resulting from the use of the content of its websites or of websites linked to the Gusto Casa Website, for example by means of hyper(text)link(s) or metatag(s). Gusto Casa is furthermore not liable for damage arising from or connected with the use, or the impossibility of use, of material available on its websites or obtained via cookies. Gusto Casa is not liable for damage resulting from the use of third-party services and/or information offered via the Gusto Casa Website.

Gusto Casa is furthermore not liable for damage resulting from the use of electronic means of communication with its websites, including – but not limited to – damage resulting from non-delivery of, or delay in delivering, electronic messages, interception or manipulation of electronic messages by third parties or by software/equipment used for electronic communication, and the transmission of viruses. The above limitations of liability do not apply if the damage results from intent or gross negligence on the part of Gusto Casa.

Gusto Casa does not guarantee that the information and material offered on the Website is up to date, complete and/or accurate. Nor does Gusto Casa guarantee that the information offered on its websites is free of errors, defects and/or viruses. Furthermore, Gusto Casa does not guarantee that any such errors and/or defects in the Website will be corrected or viruses removed.

You indemnify Gusto Casa against all claims by third parties for damage that they have suffered (or claim to have suffered) as a result of

• the use of information on the Gusto Casa Website posted by you or by (legal) persons acting on your instructions;
• which otherwise relate to or arise from your use of the Gusto Casa Website.

Where restrictions on the permitted search area are indicated on the Gusto Casa Website, you must check for yourself whether your advertisement complies with them. Gusto Casa reserves the right to remove advertisements that do not fit.

Which law applies to these Terms of Use?

These Terms of Use are governed by Dutch law. Any dispute about these Terms of Use will be submitted to the competent court in Utrecht.
